Terms of service
These terms of service ("Terms") apply to the games published by Magus Play ("we", "us"), such as Peskac: Hearts & Sevens, and to this website. By installing or playing our games you accept these Terms. If you do not agree, please do not use the games.
1. The games
Our games are free to download and play. Some features need an internet connection or an account. We may change, add or remove features, game modes and content to improve the games.
Computer-controlled players. Offline games are played against computer-controlled players. Online, while there are not enough people looking for a game, empty seats at quick-match and private tables may be filled with computer-controlled players, so you do not have to wait. They appear with a name and a picture like other players, play by the same rules, and do not earn coins, become friends or appear in rankings.
2. Accounts
You can play as a guest or create an account with an email address, Google or Apple. Give accurate information, keep your password secret, and remember that you are responsible for what happens with your account. You must be at least 13 years old (16 in the European Union), or have the permission of a parent or guardian. You can delete your account at any time (see the privacy policy).
3. Fair play
Play fairly and respect the other players. You must not:
- cheat, or use bots, exploits, modified apps or automation;
- harass, threaten or insult other players;
- use offensive, misleading or infringing names or avatars, or pretend to be someone else;
- attack or overload our servers, or try to access them or other players' accounts without permission;
- sell, buy or trade accounts, coins or items.
4. Virtual coins and items
The games may include virtual coins and items that you earn by playing, receive for watching ads, or buy with real money. Coins and items:
- have no cash value and cannot be exchanged for money or anything else of value outside the game;
- give you a limited, personal licence to use them in the game, and are not your property;
- cannot be transferred to another account or another game;
- are not refundable, except where the law or the rules of the App Store or Google Play require it.
We may change prices, amounts and the items on offer. If your account is deleted or closed, its coins and items are lost.
5. Purchases and subscriptions
All purchases are made through the Apple App Store or Google Play and are also governed by their terms. The "No ads" subscription costs the price shown in the store (for example $2.99 per month) and renews automatically until you cancel it. It is billed and managed by Apple or Google: you can cancel it at any time in the subscription settings of the App Store or Google Play, at least 24 hours before the end of the current period. Deleting the app or your account does not cancel a subscription. Refunds are handled by Apple or Google under their own policies. If you live in the EU, you agree that digital content is delivered immediately, and you acknowledge that, where the law allows it, you lose your right of withdrawal once the delivery has started.
6. Advertising
The free version of our games shows ads from third parties, such as Google AdMob, and our own ads. We are not responsible for the content of third-party ads or the sites they lead to. The subscription removes the ads in the game it was bought for.
7. Your content
The name and avatar you choose are visible to other players. You keep any rights you have in them and allow us to show them in our games while you use them. We may change or remove names and avatars that break these Terms.
8. Our rights
The games, their software, graphics, sounds and trademarks belong to Magus Play or its licensors. We give you a personal, limited, non-exclusive licence to use the games for your private, non-commercial entertainment. You may not copy, modify, distribute, sell or reverse engineer the games, except where the law allows it.
9. Suspension and termination
We may suspend or close accounts that break these Terms or harm other players or the service, with a warning first where that is reasonable. You can stop using the games and delete your account at any time. We may stop offering a game; if we do, we will try to tell you in advance.
10. Disclaimers
The games are provided "as is" and "as available". We do our best, but we cannot promise that the games will always be available, uninterrupted or free of errors, or that progress will never be lost. Nothing in these Terms limits the rights you have under consumer protection laws that cannot be excluded.
11. Limitation of liability
As far as the law allows, Magus Play is not liable for indirect or consequential losses, lost profits or lost data, and our total liability to you is limited to the amount you paid us in the 12 months before the claim. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that the law does not allow us to limit.
12. Changes to these Terms
We may update these Terms. We will publish the new version on this page with a new "last updated" date and, for important changes, tell you in the app. If you keep playing after a change, the new Terms apply.
13. Governing law
These Terms are governed by the laws of [jurisdiction]. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim before the courts where you live.
